New York Expands Coverage for Pregnancy-Related Temporary Disability Benefits

Effective January 1, 2024, New York has made amendments to laws relating to pregnancy-related temporary disability benefits.


The expanded coverage now includes prenatal time as well as recovery from pregnancy loss or stillbirth:

  • New York temporary disability insurance will increase prenatal coverage from 2 weeks to 4 weeks prior to an estimated due date and up to 6-8 weeks following birth, depending on the type of delivery. Any additional coverage requires medical certification.
  • Also captured under existing language, employees recovering from pregnancy loss in the second trimester or a stillbirth may be covered under disability for 2-8 weeks from the loss.
