Massachusetts Updates Guidance on Using PTO with Paid Family and Medical Leave Benefits

The Massachusetts Department of Family and Medical Leave (DFML) issued new guidance on using paid time off (PTO) with Massachusetts Paid Family and Medical Leave (PFML) benefits.


The updated FAQs noted that the employer’s policy would dictate whether employees are able to supplement partial pay from PFML with PTO:

  • An employer’s policy may specify whether and how employees can use PTO to “top off” PFML benefits.
  • Employer policies must not discriminate against employees exercising their PFML rights.
  • Employers should communicate “top off” options to employees by informing them that they may use accrued PTO to supplement PFML benefits while on leave, subject to company policy and capped at the individual’s average weekly wage.
